8.4 Planned transborder flows of personal information
The Company uses service providers that store or process personal information outside the Republic, mainly in the United States of America and the European Union. These include its website hosting provider (Vercel), email delivery provider (Resend), its email, file storage and analytics provider (Google), and cloud design and accounting tools. The categories affected are enquiry and client information, project data, correspondence and website usage information. Transfers are made under binding agreements that provide protection substantially similar to POPIA, as section 72 of POPIA requires. Website processing and private file and enquiry storage are configured in Cape Town. Authorised website support may access relevant records from New Zealand through On a Digital Note. Google Search Console provides reports about the site in Google Search without adding a tracking script to the website.
8.5 Information security measures
The Company applies measures that include: role-based access controls and multi-factor authentication; encrypted connections to its websites and encrypted cloud infrastructure; secure local storage and firewall protection; regular review of staff and contractor access privileges; non-disclosure agreements and confidentiality clauses with staff, suppliers and partners; written agreements with service providers that process personal information; expiry of uploaded-file download access after 7 days, followed by scheduled deletion from website storage; and physical security controls at its offices and manufacturing facilities.
9. How to request access to a record
- Complete Form 2 of the PAIA Regulations, available from the Regulator's website or from our Information Officer.
- Give enough detail for us to identify the record and you, state the form of access you require, and identify the right you are seeking to exercise or protect and why the record is required to exercise or protect it.
- If you are making the request on behalf of someone else, provide proof of your authority to do so.
- Send the form to the Information Officer at wilhelm@fcdspars.com or to the postal address in section 3.
We will decide on a request within 30 days of receiving it and tell you our decision. PAIA allows this period to be extended once, by up to 30 days, in limited circumstances. We will tell you if that happens.
10. Fees
The fees prescribed for private bodies apply. At the date of this manual they include:
Item | Fee |
|---|---|
Request fee, payable by every requester other than a person requesting their own personal information | R140.00 |
Photocopy or printed copy of an A4 page | R2.00 per page |
Copy on a flash drive or compact disc supplied by the requester | R40.00 |
Search and preparation of a record, per hour after the first hour | R145.00, to a maximum of R435.00 |
Deposit, where search and preparation will take more than six hours | One third of the access fee |
The full schedule is published on the Regulator's website.
11. Grounds for refusing access
We may, or in some cases must, refuse access to a record on the grounds set out in Chapter 4 of Part 3 of PAIA. These include: protecting the privacy of a third party who is a natural person; protecting the commercial or confidential information of a third party; protecting the safety of individuals and the security of property; records privileged from production in legal proceedings; protecting our own commercial information and trade secrets; and protecting research information of a third party or of the Company. Access must still be given where the public interest override in section 70 of PAIA applies. Where a third party's information is involved, we are required to notify that third party before deciding.
12. Remedies if a request is refused
The Company has no internal appeal procedure. If you are not satisfied with a decision of the Information Officer, you may lodge a complaint with the Information Regulator within 180 days of being told of the decision, by email to PAIAComplaints@inforegulator.org.za. If you are not satisfied with the outcome of that complaint, you may then apply to a court with jurisdiction.

This manual is available on our website, at our head office for inspection during normal business hours, to any person on request on payment of the prescribed fee for copies, and to the Information Regulator on request.
14. Updating of this manual
