1. About these terms

This website, fcdspars.com, is operated by Fused Composite Design (Pty) Ltd ("we", "us"). FCD Spars is our product brand for carbon fibre spars.

These terms govern your use of the website. By using it, you agree to them. If you do not agree, please do not use the site.

These terms do not govern the supply of any product or engineering service. Supply is governed only by a written agreement signed with us for that project.

These terms should be read with our Privacy Notice, Cookie Policy and Technical Content Disclaimer, which form part of them.

2. Using the site

You may use the site to learn about our work and to contact us. You may not:

• use it in any way that breaks the law or infringes someone else's rights;
• attempt to gain unauthorised access to the site, its servers or any connected system;
• introduce malicious code, or upload files that you know to be harmful;
• copy the site or its content in bulk by automated means;
• submit false information, or enquiries on behalf of someone else without their authority.

3. Intellectual property

Everything on this site belongs to us or to those who have licensed it to us. This includes the text, photographs, video, renders, 3D models, drawings, diagrams, the FCD Spars and Fused Composite Design names and logos, and the design of the site itself.

You may view the site and print or save pages for your own evaluation of our work. You may not otherwise reproduce, adapt, publish or commercially use any content without our written permission. You may not extract geometry or design data from the renders, 3D models or drawings, or use them to design or manufacture anything.

Vessel names, client names, and third-party marks and footage shown on the site belong to their owners and appear with permission.

4. Technical content

Technical information on this site is illustrative. It is not a specification, an engineering recommendation or a warranty, and you must not rely on it to specify, design, purchase or install any component. Our Technical Content Disclaimer sets this out in full.

5. No offer to supply

Nothing on this site is an offer to sell or a commitment to supply. Every spar is engineered for a specific vessel, and any proposal, price, lead time or specification is valid only when we give it to you in writing for your project.

We supply customers in South Africa and internationally, subject to applicable export control, customs and sanctions laws. We may decline an enquiry or an order where those laws, or our own assessment, require it.

6. Enquiries and material you send us

When you send us an enquiry, the submission terms shown with the form apply. In summary: you confirm that you are entitled to share what you send; you keep ownership of it; we use it only to assess and respond to your enquiry and to keep a record of it; and no confidentiality or supply obligation arises beyond what those terms state until a written agreement is signed.

7. Links to other sites

The site links to social media platforms and to other organisations. We do not control those sites and are not responsible for their content or their handling of your information.

8. Availability

We aim to keep the site available and accurate, but we provide it as it is. We may change, suspend or withdraw any part of it without notice, and we do not promise that it will be uninterrupted or free of errors.

9. Our liability

Please read this section carefully. It limits our liability to you.

As far as the law allows, we are not liable for any loss or damage arising from your use of this site, from your inability to use it, or from your reliance on anything published on it. This includes direct loss, indirect or consequential loss, loss of profit, and loss or corruption of data.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. This includes liability for fraud or gross negligence, liability for death or personal injury that the law does not allow us to exclude, and liability under consumer protection or product liability law that applies to you.

Our responsibilities for any product or service we supply are set out in the written agreement for that supply, not in these terms.

10. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The courts of South Africa, and in particular the Western Cape Division of the High Court in Cape Town, have jurisdiction over any dispute about the site or these terms.

If you are a consumer living in another country, this does not take away any protection that the mandatory laws of your country give you.

11. General

We may update these terms from time to time. The version and date at the top show the current version, and your continued use of the site means you accept it.

If any part of these terms is found to be unenforceable, the rest remains in force.
